Establecer un waqf significa donar una propiedad para emplear sus beneficios por la causa Allah. Lo que se entiende por propiedad es algo de lo que se pueda obtener algún beneficio mientras que su esencia permanezca, por ejemplo, casas, tiendas, fincas, etc. Lo que se entiende por beneficios es el resultado que proviene de algún uso de esa propiedad, como los cultivos, los alquileres o el otorgamiento de refugio. The one who establishes the waqf should be one who has the authority to dispose of this wealth. The property given as waqf should be something from which ongoing benefit may be derived whilst its original essence remains. It is obligatory to act in accordance with the wishes of the one who set up the waqf so long as it does not go against the Shari`ah. If this land on which he wants to build a private shop is land that was given as a waqf (endowment) for the mosque – meaning that it is part of the mosque that was built for prayer, or it is part of its environs – then it is not permissible to use it for private enterprises and personal matters under any circumstances.
